A class action has been filed for customers of audiobooks sold by Audible, Amazon and Apple. In 2003, Audible and Apple entered into an exclusivity agreement for the sale of audiobooks in Canada. The agreement ended at the end of 2017. This class action lawsuit alleges the agreement was illegal for violating competition law in Canada. Audible and Apple charged higher prices to consumers as a result of their illegal agreement.
The plaintiff argued that the case should be certified as a class action. In 2022, the BC Supreme Court dismissed the plaintiff’s application for class certification. A copy of that decision is available here. The plaintiff appealed the decision, and the appeal was dismissed by the BC Court of Appeal in 2023.
